1. Acceptance
By creating an account, publishing a listing, or paying for a listing, you agree to these Terms, the Privacy Policy and the Liability Waiver. We keep a record of the version you accepted, the date, and your account.
2. Operator
My Equine Tack LLC operates this website. Your contract is only with My Equine Tack LLC.
3. The service
My Equine Tack is a marketplace where users publish and find listings for equestrian equipment and tack. Users may buy, sell, or rent items between themselves. My Equine Tack does not own, inspect, store, deliver, or guarantee any item, and is not a party to any sale, rental, or other agreement between users.
4. Eligibility
You must be at least 18 years old and able to enter a binding contract.
5. Accounts
You are responsible for your login and for all activity on your account. Tell us immediately at myequinetack@hotmail.com about any unauthorised use.
6. Listings
You are solely responsible for the accuracy of your listings, including photos, descriptions, condition, prices, and availability. Used items must be described honestly.
7. No verification
Unless the website clearly states otherwise, My Equine Tack does not verify identity, the condition, safety, or fit of any item, or the authenticity of any product. Buyers must inspect items and check safety, fit, and condition themselves before buying or using them.
8. Prices
A listing is published after a one-time payment for that listing. Standard: $4.99 USD. Premium: $9.99 USD. Each listing stays published for up to 2 months from the date of payment. All prices are in US dollars.
9. No subscription and no automatic renewal
A listing purchase is a single payment. It does not renew automatically. To publish another listing, or to republish one, you must pay again.
10. Refunds
Once a listing is published, the payment is not refunded, except where Florida law requires it, or where the listing could not be published because of a fault on our side.
11. Failed payment
If a payment is declined or not completed, the listing is not published.
12. Suspension and removal
We may suspend or remove a listing or account that breaks these Terms, is fraudulent, unsafe, or illegal, or when the law requires it. If a listing is removed for a reason on our side, we may offer a replacement listing period at our discretion.
13. Disputes and arbitration
Any dispute between My Equine Tack LLC and a user, or between users concerning this website, will be resolved by individual, binding arbitration under the Federal Arbitration Act. The arbitration takes place in Florida, in English, before one neutral arbitrator. Each party pays its own costs unless the arbitrator decides otherwise. Claims within the jurisdiction of the Florida small claims court may be brought there instead. Either party may seek urgent interim relief from a court. You may opt out of this arbitration clause by sending written notice to myequinetack@hotmail.com within 30 days of your first purchase or account creation.
14. Class action waiver
To the fullest extent the law allows, you waive any right to take part in a class action, collective action, or representative action against My Equine Tack LLC. Each dispute is resolved individually.
15. Content licence
You keep ownership of the content you publish. You grant My Equine Tack LLC a non-exclusive, worldwide licence to host, display, and reproduce that content as needed to operate the service.
16. Limitation of liability
To the fullest extent the law allows, My Equine Tack LLC is not liable for indirect, incidental, special, or consequential damages, or for losses arising from any sale, rental, or other agreement between users, or from the condition, safety, fit, or authenticity of any item listed.
17. Indemnity
You agree to defend, indemnify, and hold harmless My Equine Tack LLC, its officers, members, and staff from claims arising from your use of the website, your listings, or your agreements with other users.
18. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.
19. Changes
We may update these Terms. We will notify users of material changes before they take effect.
20. General
If any part of these Terms is found unenforceable, the rest remains in effect.
