1. Purpose
This Liability Waiver applies to your use of the My Equine Tack website and to any item you buy, sell, rent, or use that you find or arrange through it.
2. Equipment risks
Equestrian equipment can fail or be misused. Risks include, but are not limited to, broken or worn tack, poor fit, incorrect adjustment, helmets or protective gear that do not meet safety standards, and falls or injuries from using equipment in unsuitable conditions or with horses and animals.
3. Our role
My Equine Tack LLC publishes listings and connects independent users. My Equine Tack LLC does not inspect, certify, test, store, or deliver any item, and is not a party to any agreement between users.
4. No inspection or guarantee
My Equine Tack LLC does not guarantee the condition, safety, fit, authenticity, legality, or quality of any item, or the accuracy of any listing.
5. Your responsibility
You are responsible for inspecting any item before buying or using it, checking that it fits and is safe for you and your horse or animal, confirming that it meets any applicable safety standard, and using it correctly.
6. Assumption of risk
By using the website or buying, selling, renting, or using an item found through it, you knowingly and voluntarily accept the risks described in this waiver.
7. Emergencies
My Equine Tack LLC does not provide medical, veterinary, rescue, or emergency services. In an emergency, contact the appropriate emergency services.
8. Florida Equine Activity Liability Act
Florida Statutes Chapter 773 (sections 773.01 to 773.06) addresses liability for injuries from the inherent risks of equine activities. Where that law applies to an activity or a provider, the warning it requires must be given. Nothing in this waiver removes any protection or obligation that Chapter 773 gives or imposes.
9. Release
To the fullest extent the law allows, you release My Equine Tack LLC, its officers, members, managers, employees, and agents from any claim arising from your use of the website or from any item bought, sold, rented, or used through it, including injury, death, property damage, animal injury, financial loss, and disputes between users.
10. What this waiver does not cover
This waiver does not release My Equine Tack LLC from liability for intentional misconduct, gross negligence, or any obligation that Florida law does not allow to be waived.
11. Acceptance
When you create an account, you must tick the box "I have read and accept the Liability Waiver," then click to accept. We record the version accepted, the date, the time, and your account. Using the website after that confirms your acceptance.
